Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Born Digital platform available at tribes.borndigital.co (the “Service”), operated by Born Digital SAS. By accessing or using the Service, you agree to these Terms.
1. The Service
Born Digital is a social media management platform that lets agencies and brands schedule publications, manage a media library, publish content to connected social accounts (including TikTok, Instagram and Facebook), and monitor post performance from a single dashboard.
2. Accounts and eligibility
Access to the Service requires an account, which is provided to authorized professional users. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You must be at least 16 years old and able to enter into a binding agreement to use the Service.
3. Connecting third-party platforms
The Service lets you connect your own third-party social accounts through their official authorization flows (OAuth). By connecting an account, you confirm that you are authorized to manage it and you grant Born Digital permission to perform, on your behalf, the actions you initiate (such as publishing videos and retrieving insights). Your use of each third-party platform remains subject to that platform’s own terms and policies, including the TikTok Terms of Service. You are responsible for complying with them.
4. Acceptable use
You agree not to use the Service to:
- publish content that is unlawful, infringing, misleading, or that violates the rules of any connected platform;
- infringe the intellectual property or privacy rights of others;
- upload malware or attempt to disrupt, reverse-engineer or gain unauthorized access to the Service;
- use the Service to send spam or otherwise abuse connected platforms’ APIs.
5. Your content
You retain all rights to the content you upload or publish through the Service. You are solely responsible for that content and for ensuring you have the necessary rights and permissions to publish it. You grant Born Digital the limited rights needed to host, process and transmit your content for the purpose of operating the Service.
6. Intellectual property
The Service, including its software, design and trademarks, is and remains the property of Born Digital SAS and its licensors. These Terms do not grant you any right to use Born Digital’s trademarks or other intellectual property except as necessary to use the Service.
7. Availability and changes
We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue all or part of the Service, and we may update these Terms; continued use after changes take effect constitutes acceptance of the revised Terms.
8. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind to the extent permitted by law. We are not responsible for the availability, behaviour or policies of third-party platforms, or for content published through connected accounts.
9. Limitation of liability
To the maximum extent permitted by law, Born Digital shall not be liable for any indirect, incidental or consequential damages, or for loss of data, revenue or profits, arising from your use of or inability to use the Service.
10. Termination
You may stop using the Service at any time and request that your account be closed. We may suspend or terminate access if you breach these Terms or use the Service in a way that could harm Born Digital, its users or third-party platforms.
11. Governing law
These Terms are governed by French law. Any dispute relating to the Service shall be subject to the jurisdiction of the competent courts of Paris, France, subject to any mandatory consumer protection rules that may apply.
